1. Acceptance of Terms
Welcome to studioebeth.com (the “Site”), owned and operated by Studio Ebeth LLC, a California limited liability company doing business as “Studio Ebeth Photography” (“Studio Ebeth,” “we,” “us,” or “our”), based in San Diego, California. By accessing or using this Site, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, please do not use the Site.
These Terms govern your use of the Site itself. They do not replace or modify the Photography Services Agreement that governs any photography session you book with us — that agreement controls the terms of your specific session, deliverables, usage rights, and cancellation policy.
2. Who We Are
Studio Ebeth LLC is a photography business serving San Diego County and surrounding areas, offering family, couple, portrait, pet, and mini photography sessions, along with our Forever Sessions offering in partnership with Frosted Faces Foundation.

3. Use of the Site
You may use this Site for lawful purposes only. You agree not to:
Use the Site in any way that violates applicable local, state, national, or international law
Attempt to gain unauthorized access to any portion of the Site, related systems, or networks
Interfere with or disrupt the Site's functionality, servers, or networks
Scrape, copy, or harvest content from the Site through automated means without our written permission
Use the Site to transmit any harmful code, viruses, or malicious software
Impersonate any person or entity, or misrepresent your affiliation with any person or entity
4. Intellectual Property
All content on this Site — including but not limited to photographs, images, text, logos, graphics, and design elements — is the property of Studio Ebeth LLC or is used with permission, and is protected by copyright and other intellectual property laws.
You may view and share content from the Site for personal, non-commercial purposes (for example, sharing a link to a blog post on social media). You may not:
Download, reproduce, distribute, or publicly display any photographs from the Site without our prior written consent
Use any images, text, or branding from the Site for commercial purposes
Remove any copyright, trademark, or proprietary notices from Site content
Client photographs delivered as part of a booked session are governed separately by the usage rights outlined in your Photography Services Agreement.
5. Bookings and Inquiries
Session bookings and payments made through this Site are processed via Pixieset and Stripe, third-party platforms not owned or operated by Studio Ebeth LLC. Submitting a booking inquiry or deposit through the Site does not itself constitute a binding agreement — your session is governed by the fully executed Photography Services Agreement between you and Studio Ebeth LLC.
We reserve the right to decline any booking inquiry at our discretion.
6. Third-Party Links and Services
This Site may contain links to third-party websites or services (including Pixieset, Instagram, and Frosted Faces Foundation) that are not owned or controlled by Studio Ebeth LLC. We are not responsible for the content, privacy practices, or terms of any third-party sites. Your use of those sites is subject to their own terms and policies.
7. Disclaimers
The Site and its content are provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not guarantee that the Site will be uninterrupted, secure, or error-free, or that any information on the Site is complete, accurate, or current.
8. Limitation of Liability
To the fullest extent permitted by law, Studio Ebeth LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Site. This limitation does not apply to matters governed by your Photography Services Agreement, which contains its own liability terms specific to session services. Nothing in these Terms limits or excludes liability for fraud, willful injury to person or property, or violation of law, consistent with California Civil Code section 1668.
9. Indemnification
You agree to indemnify and hold harmless Studio Ebeth LLC, its owner, and any affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Site.
10. Privacy
Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.
11. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated “Last Updated” date. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in San Diego County, California.
